General Terms and Conditions of Sale
ARTICLE 1: SCOPE OF APPLICATION
The present General Terms and Conditions of Sale apply to all orders placed on the www.icarsofteurope.com site operated by the company ALP DISTRIBUTION, located at 8 allée du 22 janvier 1993 in Longvic (21600), France. The icarsofteurope.com site reserves the right to adapt or modify at any time the present General Terms and Conditions of Sale. In case of modification, the general sales conditions in force at the day of the order will be applied to each order.
ARTICLE 2: PRICE
The prices of our products are indicated in euros, all taxes included, processing and shipping costs included, only for Metropolitan France. Outside France, delivery costs will be charged at the price of the postal rates in force at the time the order is placed. All orders, whatever their origin, are payable in euros. ALP DISTRIBUTION and its website icarsofteurope.com reserve the right to modify the prices at any time, but the products will be invoiced on the basis of the prices in force at the time of the registration of the orders. The products remain the property of the company until full payment of the price (base, fees and taxes) is received by its website icarsofteurope.com
ARTICLE 3: ORDERS
You hereby acknowledge that you have read and accepted these General Terms and Conditions of Sale before validating your order. The validation of your order therefore implies acceptance of these General Terms and Conditions of Sale. The information, photos and graphics of the catalogues are only indicative and do not commit the seller. The data recorded by the icarsofteurope.com site constitute proof of all transactions between its website and its customers. For orders placed on its internet site icarsofteurope.com, the ALP DISTRIBUTION company reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order.
ARTICLE 4: AVAILABILITY
Our product offers and our prices are valid as long as they are visible on the site, within the limits of available stocks. For products that are not stocked in our premises, our offers are valid subject to availability from our suppliers. The information comes directly from our suppliers, errors or modifications may exceptionally exist. In the event of the unavailability of one or more products after validation of your order, we will inform you by any means (e-mail, mail or telephone) upon receipt of the information received from the suppliers. In case of unavailability of all or part of the order, and if the buyer does not opt for a replacement product or a credit note, the refund will be made at the choice of icarsofteurope.com by crediting the customer's bank account, at the latest within thirty days from the payment of the sums paid by the customer.
ARTICLE 5: PAYMENT
Apart from exceptional cases or special agreement between the icarsofteurope.com site and the customer, all purchases made on the icarsofteurope.com site are to be paid at the time of order. In the case of a delay of payment of an order integrating this exceptional situation, penalties of an amount equal to the bank base rate will be automatically applied to the unpaid amounts at the end of a period of 10 days following the date of invoicing or as soon as the notification of the rejection of the bank payment. ARTICLE 6: DELIVERY - GENERAL INFORMATION
The delivery is considered to have been made as soon as the products are made available to the customer. It is therefore the responsibility of the customer to check the shipments on arrival and to make any reservations and complaints that may appear justified to the delivery man. If the nature or quality of the products delivered do not conform to the indications on the corresponding delivery note, the customer must express his complaints in writing within TWO (2) days following this delivery, otherwise entitlement will lapse. The delivery times are the usual average times and correspond to the processing and shipping times plus the delivery time. The products are delivered to the delivery address that you have indicated during the ordering process. The icarsofteurope.com site and the ALP DISTRIBUTION company cannot be held responsible for the consequences due to a delay in delivery. In the event of a delay in delivery, you will be informed by email.
COVID-19: all our shipments are made with a signature service upon receipt of the package. Despite the selection of this delivery method, some carriers are allowed by public authorities not to have the recipient sign for the package and to deliver it directly to his letterbox.
iCarsoft Europe cannot be held responsible if the parcel sent is indicated as delivered to the letterbox and the customer indicates that he has not received the parcel. Once iCarsoft Europe has provided proof that the parcel has been sent to the address indicated by the customer at the time of ordering and the parcel has been confirmed as delivered, responsibility for any loss of the parcel lies with the carrier.
ARTICLE 7: VAT, IMPORT TAXES AND CUSTOMS DUTIES
Important information for customers outside the European Union economic area. (including the United Kingdom)
iCarsoft Europe is represented by the company ALP Distribution which is registered in Dijon, France.
If your place of residence is outside the European Union, we will invoice you without applying the French VAT of 20%.
On the other hand, you will have to pay the VAT when your parcel arrives in your country of residence with possible taxes or customs duties depending on your country of residence.
ARTICLE 8: RETURNS - PRODUCT CONFORMITY
We undertake to refund you or to exchange products that appear to be faulty or do not correspond to your order. In this case, we kindly request you to state in detail in writing, to wait for our agreement also in writing, and to send us back the products with our agreement. The icarsofteurope.com site will either exchange or refund the product(s), as you wish. The request must be made within thirty calendar days following the delivery. Any claim made outside this period will not be accepted. The products must be returned to us in the condition in which you received them with all the elements delivered (accessories, packaging, instructions, etc.). The return costs are your responsibility. Your exchange or refund will be made within 1 to 10 days from the date of receipt of your returned product in our premises.
ARTICLE 9: PRODUCTS WARRANTY
Some of the products sold are covered by a manufacturer's warranty. Any product modified or repaired by the purchaser or by any other person not expressly authorised by the seller, as well as any product covered by a specific assistance and maintenance contract, are excluded from this warranty. In order to benefit from the product warranty, it is necessary to keep the purchase invoice of the product. The contractual warranties do not cover: - the replacement of consumables, - abnormal or non-compliant use of the products, - breakdowns linked to accessories (power cables, etc.), - defects and their consequences due to the intervention of a non-approved repairer, - defects and their consequences linked to use that is non-compliant with the use for which the product is intended, - defects and their consequences linked to any external cause. However, in any case you benefit from the provisions of the legal warranty in particular those relating to the warranty of the hidden defects. Any return of the product under the warranty must be subject to a prior agreement by the icarsofteurope.com site. To this end, the buyer will contact the customer service of the icarsofteurope.com site by making his request by mail or e-mail via the "Contact us" page. If the product is considered as being faulty, icarsofteurope.com will send its return agreement by e-mail. The faulty product must be returned in its original packaging and with the agreement of icarsofteurope.com which will have taken care to send the return details to the customer beforehand. All costs and risks related to the return of the product are at the expense of the buyer. No shipment in cash against delivery will be accepted whatever the reason.
ARTICLE 10: RIGHT OF WITHDRAWAL
In accordance with the article L.121-21 and following of the French Consumer Code, the consumer has a period of 14 calendar days as from the date of delivery of his order, to return any article that would not meet his expectation and ask for an exchange or a refund without penalty. icarsofteurope.com extends this legal period to 30 days as from the date of validation of the order. Any natural person who acts for purposes that do not fall within the scope of its commercial, industrial, craft or liberal activity is considered a consumer. Hence, the withdrawal period does not apply to a sale made to a professional or a need for professional activity. This right of return can only be accepted for complete products. Upon receipt of your return, if you have requested an exchange of the product, we will send you the replacement product within 7 days if it is in stock (within 30 days maximum in other cases). If you have requested a refund, this will be made within 14 days at the latest. No shipment in cash against delivery will be accepted whatever the reason.
